Abstract

The metaverse offers to users a lot of opportunities to develop inventions such as hardwares, softwares, tools and technologies enabling a completely realistic immersive experience. Inventions can be developed for and in the metaverse. Regarding such new technologies, any patent lawyer may raise the question of patentability: Under which conditions can an invention be patentable? The answer depends on the choice of law. Some inventions may be patentable according to major jurisdictions, providing that the patent applicant meets the legal requirements for patentability. But certain legal systems refuse to grant utility patents on the grounds of public order. This Chapter intends to analyse and discuss the patentability of inventions developed for and in the metaverse, with the understanding that utility patent issues are far more insightful than design patent ones.
